Referenda for Capital Projects
In 2008, Indiana House Enrolled Act 1001 changed the landscape for how many common capital projects funded by property tax dollars are to be financed. Specifically, the HEA 1001 inserted election law and electoral politics into the process by requiring certain projects be approved by referendum. In addition, HEA 1001 placed specific restrictions on the ability of government entities to campaign or otherwise work for a successful outcome in the referendum.

In the 2008 general election in Marion County, one of our attorneys actually administered the first capital project referendum in the State of Indiana under HEA 1001.
